Dear Faculty and Staff,

We want to inform you of a new federal law that offers employees additional protections as a result of the COVID-19 pandemic.

Effective April 1 through Dec. 31, 2020, employees will have additional emergency leave options related to COVID-19. These provisions are required of all employers based on the Families First Coronavirus Response Act, which was signed into law March 18.

As a result of the SDBOR’s emergency paid leave provisions (administrative leave) related to COVID-19, which exceed the federal benefits, employees should not require federal benefits until after May 14, when Gov. Noem’s emergency order is expected to expire.

While the federal law goes into effect April 1, USD full-time employees already have access to leave through the South Dakota Board of Regents (SDBOR). For employees who are unable to work, remotely or on-campus, the SDBOR will offer:

  1. COVID-19 Emergency Paid Sick Leave, which provides eligible employees who cannot work up to 80 hours of paid sick leave. 
  2. COVID-19 Related FMLA Leave, which provides eligible employees who cannot work up to two-thirds pay after 10 days of unpaid leave to care for children under the age of 18 years.

Both leaves have additional qualifications. To apply for either type of leave, please email hr@usd.edu. You will receive a DocuSign email with the application. Human Resources will process the request and work with you during payroll processing.
